The short version: these terms cover using our website. Any work we do on your home is covered by the written estimate or agreement you approve for that job, not by these terms.

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Hudson My Home LC ("Hudson My Home," "we," "us"). They apply to our website at hudsonmyhome.app (the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

2. Who can use the Services

You must be at least 18 years old to use the Services or submit a request through them.

3. Using the Services

You may use the Services for their intended purpose: learning about our services and contacting us. You agree not to:

• Submit false information or requests in someone else's name
• Upload anything illegal, harmful, or that you don't have the right to share
• Send spam, malware, or automated submissions through our forms
• Scrape, copy, or collect content or data from the Services with automated tools
• Interfere with the security or operation of the Services

4. Requests and our home services

Submitting a service request or booking a discovery call through the Services doesn't create an obligation for either of us to go forward, and we may decline any request.

Any work we perform on your property is governed by the written estimate, quote, or service agreement you approve for that job, which sets the scope, price, payment, and any warranty. These Terms don't cover the work itself.

5. Communications and text messaging

By giving us your contact information, you agree that we can contact you by email, phone, and text about your request.

• What we send: Texts about your service requests, appointment scheduling and reminders, estimates, invoices, project updates, and customer support. If you separately opt in to marketing texts, we may also send occasional promotions. Marketing texts may be sent using automated technology.
• Consent: Agreeing to marketing texts is not a condition of buying anything from us.
• Message frequency: Message frequency varies based on your requests and projects.
• Costs: Message and data rates may apply.
• Opting out: Reply STOP to any message to stop receiving texts. You'll receive one confirmation text, and then no further messages unless you opt back in.
• Help: Reply HELP for help, or contact us at (515) 216-4447 or [email protected].
• Carriers: Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: Your information is handled as described in our Privacy Policy. We do not share your mobile number or text messaging consent with third parties for their marketing purposes.

6. Content you submit

You keep ownership of the photos, files, and information you send us through the Services. You give us permission to use them to review and respond to your request. You confirm you have the right to share what you upload.

7. Our content

The Services, including our name, logo, text, images, and design, belong to Hudson My Home LC or our licensors. You may not copy or reuse them without our written permission.

8. Third-party services

The Services may link to or rely on services from other companies. We're not responsible for third-party services, and your use of them is governed by their own terms.

9. Disclaimers

The Services and their content are provided "as is" and "as available" for general information. Tips, articles, or general guidance on our website or in our emails are not a substitute for an on-site professional evaluation of your home. To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Services will always be available or error-free.

10. Limitation of liability

To the fullest extent allowed by law, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim arising from the Services is limited to $100. Nothing in these Terms limits liability that can't be limited by law.

11. Indemnification

You agree to cover our reasonable losses and costs, including legal fees, from claims caused by your breach of these Terms or content you submit through the Services.

12. Governing law and disputes

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. If a problem comes up, please contact us first. If we can't resolve it within 30 days, either of us may bring a claim in the state or federal courts located in Iowa, and we both agree to those courts' jurisdiction. Either of us may also bring an eligible claim in small claims court.

13. Changes and termination

We may update these Terms. We'll change the effective date at the top and give notice of significant changes. We may suspend or end your access to the Services if you violate these Terms. Sections that by their nature should survive, such as disclaimers, limitation of liability, and governing law, survive termination.

14. General terms

These Terms and our Privacy Policy are the entire agreement between us about use of the Services. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it.
